Gambling and gaming can be a slippery slope.

There has been a great deal of press about the various problems that gambling and gaming can cause, especially for those who are in vulnerable financial situations and/or suffer from addiction issues.

Yet gambling and gaming terms and rules are often still written in unintelligible, complex legal language.

The regulations are clear - this is not acceptable. But they are now starting to be properly enforced.

 

Gambling Commission (GC).

The GC is the sector regulator and oversees the rules for the industry.

Its Transparency rules require that consumer communications and terms are written in line with the Consumer Rights Act. Gambling and gaming operators must:

“Ensure all Significant Conditions are provided to consumers in a clear, timely, intelligible, unambiguous, transparent, non-misleading and prominent manner.”

Competition and Markets Authority and the gambling sector.

The GC has worked closely with the CMA to try to tackle this problem. The CMA has found that many online gambling operators could be breaking consumer protection law because terms and conditions and bonus promotions are not made sufficiently clear.

This led to the CMA setting out specific rules and guidance for the sector after a joint investigation with the GC.
